Your Reformer Product Warranty – Commercial Use

1.    Definitions

In this Commercial Warranty:

·         ACL means the Australian Consumer Law under Schedule 2 of the Competition and Consumer Act 2010 (Cth).

·         Commercial Use means indoor use of the Product wholly or predominantly for business, trade, studio or commercial purposes, and excludes resale, leasing, outdoor use or personal/domestic use.

·         Limited Warranty means the warranty provided under this document.

·         Limited Warranty Period means the period specified in clause 3 for each component, commencing on the Purchase Date.

·         Non-Excludable Guarantee means any guarantee, condition or warranty that cannot lawfully be excluded under the ACL.

·         Original Purchaser means the business entity that originally purchased the Product directly from Your Reformer, or, in the case of a gifted Product, the business entity first authorised to use the Product in connection with the Your Reformer App membership.

·         Product means any or all of the YR Studio Bed, YR Studio X Bed and YR Envy Bed purchased for Commercial Use.

·         Purchase Date means the date the Product is delivered to, or collected by, the Original Purchaser.

·         Purchase Terms and Conditions means the purchase terms published on the Your Reformer website, as amended from time to time.

·         Service Area means Australia and New Zealand.

·         Warranty Claim means a claim made in accordance with this Limited Warranty.

·         Your Reformer means U Be Fit Pty Ltd ACN 129 190 450 as trustee for the Stallworthy Business Trust (trading as "Your Reformer”)

 

2.    Application of This Warranty

This Limited Warranty applies only to Products purchased and used for Commercial Use.

This warranty does not apply to consumers as defined under the ACL. Consumer purchasers are covered by a separate Consumer Warranty and Returns Policy

 

3.    Warranty Periods

The Limited Warranty covers defects in workmanship and materials arising under normal use for the following periods from the date of original delivery:

4.    Repair Kits and Spare Parts

Repair kits may be provided with Products. Spare parts and consumables will be supplied under warranty where applicable and otherwise are available for purchase.

5.    Remedies and Limitations

 

5.1.  Warranty Remedy

Subject to any Non-Excludable Guarantee, if a Product is defective during the applicable Limited Warranty Period, Your Reformer may, at its discretion:

·         Repair the Product or component; or

·         Replace the Product or component with the same or a comparable model.

Any repaired or replaced component is covered for the remainder of the original Limited Warranty Period or 30 days, whichever is longer. This Limited Warranty does not extend or restart the warranty period.

5.2.  Limitation of Liability

To the maximum extent permitted by law, and where section 64A of the ACL applies, Your Reformer’s liability for a failure to comply with a Non-Excludable Guarantee is limited (at Your Reformer’s option) to:

·         the replacement of the Product or the supply of equivalent goods;

·         the repair of the Product; or

·         the payment of the cost of replacing or repairing the Product.

5.3.  Excluded Loss

To the extent permitted by law and subject to any Non-Excludable Guarantee, Your Reformer is not liable for:

·         indirect, incidental or consequential loss;

·         loss of profits, revenue, business, goodwill or opportunity;

·         loss of use or downtime;

·         costs of substitute equipment;

·         labour, transport or diagnostic costs not expressly covered under this warranty.

Nothing in this clause limits liability for loss that cannot lawfully be excluded under the ACL.

6.    Exclusions

This Limited Warranty does not cover:

·         normal wear and tear or cosmetic changes that do not affect performance;

·         improper assembly, maintenance, installation, relocation or unauthorised repair;

·         use with third-party or incompatible parts or accessories;

·         misuse, abuse, neglect or abnormal use;

·         accidents, fire, flood, electrical faults, power fluctuations, vandalism or natural disasters;

·         Products that are stolen, counterfeit, purchased from unauthorised sellers, missing serial numbers, or used outside the Service Area;

·         Products used outside the scope of Commercial Use.

7.    Repairs and Movement of Equipment

Any movement or repair of a Product by a person other than a Your Reformer-authorised service technician is undertaken at the Original Purchaser’s risk.

Your Reformer is not liable, to the extent permitted by law, for injury or property damage arising from unauthorised repairs or relocation.

8.    Costs

Subject to any Non-Excludable Guarantee:

·         Transit costs required to effect a warranty repair may be covered during the Limited Warranty Period. Outside the scope of this Limited Warranty, transit costs will be the responsibility of the Original Purchaser.

·         Installation, servicing and labour costs are not covered and will be charged separately.

 

9.    How to Make a Warranty Claim

To make a warranty claim, please provide the following:

1.    Proof of purchase (e.g.receipt or order number)

2.    Product serial number (contact us if you need help locating the serial number )

3.    Description of the defect or problem

4.    Any supporting evidence, such as photos or videos

5.    Your contact information

Claims may be submitted by either the following methods:

Please ensure your claim includes all necessary details to help us assess and process it promptly. Incomplete claims may delay the assessment or resolution.

Claims must be made within the applicable warranty period.

10.  Warranty Claim Assessment and Resolution

Once we receive your warranty claim with all required information, we will assess the claim within 10 business days.

As part of the assessment, we will determine whether the claim is covered under the Limited Warranty and the appropriate remedy, if any.

Where the claim is accepted, Your Reformer may, at its discretion, choose to repair or replace the Product or component, or provide another remedy as outlined in this warranty.

We will notify you of the outcome of the assessment and the proposed resolution, typically within 5 business days of completing the assessment, and provide instructions for any next steps.

11.  Relationship with ACL and Other Terms

This Limited Warranty:

·         Is provided in addition to, and does not limit or exclude, any Non-Excludable Guarantees under the ACL.

·         Is subject to the Purchase Terms and Conditions.

·         Constitutes the exclusive commercial warranty offered by Your Reformer for Products used for Commercial Use.

Nothing in this warranty affects any statutory rights you may have that cannot be excluded or limited by law.

12.   Privacy

Any personal information you provide in connection with a warranty claim will be collected, used, and stored in accordance with our Privacy Policy, which can be viewed at: https://yourreformer.com.au/policies/privacy-policy.

By making a warranty claim, you consent to the collection and use of your personal information for the purposes of processing and managing your claim.

13.  No Waiver or Severability

If any provision of this Limited Warranty is held to be invalid, unenforceable, or unlawful, that provision will be severed to the extent necessary and the remaining provisions will continue in full force and effect. No failure or delay by Your Reformer in exercising any right under this warranty will operate as a waiver of that right.
